Confirmation of rape? Results reveal Dani Alves’ DNA in the victim’s body

The release from custody was complicated by new evidence. Dani Alves testified in court that the oral sex was consensual. Meanwhile, DNA tests carried out by the National Institute of Toxicology and Forensic Medicine in Spain showed that semen samples taken from the victim’s underwear and vagina shortly after the incident belonged to the Brazilian player.

His testimony is incomplete at best, and if it is confirmed that oral intercourse took place, he could be convicted. The footballer has already testified falsely on several occasions. First, in statements to the media, he denied knowing the woman and having sexual or oral intercourse with her.

However, he admitted in court that the approach had indeed taken place, but with her consent. In the meantime, the victim is still telling the same story.

Dani Alves is therefore still in custody for the alleged rape of a 23-year-old girl in the toilets of Barcelona’s Sutton nightclub, which allegedly took place at dawn at the end of December last year.

After the alleged assault, the young woman was taken by ambulance the same morning to a clinic at the centre where women who have suffered sexual assault are referred.

There, the assaulted woman underwent an examination where biological samples were taken. Traces of semen were found in these samples, as well as in her underwear.

On 20 January, Dani Alves voluntarily handed over a sample of his DNA in his court declaration, at the end of which he was taken into custody, where he is still waiting for the Barcelona court to confirm or reject the appeal.

The sequence of events reported by the woman is also consistent with the knee injury she sustained in the toilet. This is according to the medical report. In addition, the police found seven fingerprints on the victim, which are consistent with her statement.

In addition, semen was also found on the floor and sink in the restroom of the aforementioned nightclub where the alleged incident occurred, and was also found on the victim’s clothing.

Moreover, there is another aspect that may be important. Alves’ defence refers to CCTV footage which shows a woman entering the toilet two minutes after the Brazilian.

Therefore, the images do not confirm that the footballer invited the victim to the toilet, as the girl’s friends testified. According to the lawyer for the thirty-nine-year-old footballer, this is perjury on their part.

However, the prosecution believes that the camera lens did not reach the entrance to the toilet, but the white shoes the player was allegedly wearing could be seen in the mirror reflection. The defence claims they belonged to another customer at the disco.

Alves’s defence then lodged an appeal with the Barcelona court, challenging the existing evidence and calling the investigation biased.

The appeal seeks to overturn the detention order for the player, who is active and still the footballer with the most titles in the history of the sport, on the grounds that there is no risk of absconding. On the other hand, it is the prosecution that fears an escape to his home country.
